A twelve year old girl underwent surgery o correct a congenital deformity. During the course of he surgery the surgeon transfused the girl with pack red blood cells. The girl was infected with AIDS from the transfusion. We sued the physician for negligently caring for the girl and medical malpractice. The girl’s hematocrit or hemoglobin never fell below normal levels and there was no loss of blood. The doctor settled the case against him for medical malpractice.
